1. Agreement
These Terms of Service (“Terms”) govern your access to and use of websites, games, and related services offered by Emergent Works (the “Studio,” “we,” “us,” or “our”), including this website and the game Logos Construct (together, the “Services”).
By visiting the website, downloading, installing, or playing our games, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Who may use the Services
You must be able to form a binding contract in your place of residence. If a game or storefront lists a minimum age or content rating, you must meet that requirement. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.
3. The Services
Emergent Works is an independent game studio. Logos Construct is a card game in development, written in the Godot Engine. Features, platforms, and availability may change as development continues. We may update, pause, or discontinue any part of the Services.
4. License to our games
Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to download and play our games for your own personal, non-commercial entertainment. We and our licensors retain all rights, title, and interest in the Services, including names, characters, artwork, audio, code, and other content. You do not own in-game items, progress, or accounts except as a limited license.
You may not, except as allowed by applicable law:
- copy, modify, distribute, sell, or lease any part of the Services
- reverse engineer or extract source code from the games except where that restriction is prohibited
- circumvent technical protections, cheat, or interfere with other players
- use our trademarks or branding without permission
- use the Services for commercial purposes without a separate written agreement
5. Godot Engine and third-party software
Logos Construct is built with the Godot Engine and may include other open-source or third-party components. Those components are licensed by their respective authors, not by these Terms. Nothing here limits rights you have under those licenses, including the Godot Engine’s MIT license.
6. Storefronts and purchases
This website does not currently sell the game. If you buy, download, or play Logos Construct or other Studio games through Steam, itch.io, a console store, a mobile store, or another platform, that platform’s terms, refund rules, and billing practices also apply. We are not responsible for the platform’s systems. Taxes, pricing, and availability may vary by region.
7. User accounts and community features
If we later offer accounts, leaderboards, cloud saves, or community features, you are responsible for the information you provide and for activity under your account. We may suspend or terminate access if we reasonably believe you have violated these Terms or that continued access would harm the Services, other users, or us.
8. User content
If you submit feedback, bug reports, or other content to us, you grant Emergent Works a worldwide, royalty-free, perpetual license to use that material to operate and improve the Services. Do not send confidential ideas you wish to keep proprietary. We may already be working on similar ideas.
9. Acceptable use
You agree not to:
- break the law or infringe anyone’s rights
- probe, scan, or attack the Services or related infrastructure
- introduce malware or attempt to gain unauthorized access
- harvest data from the website by automated means in a way that burdens the Services
- misrepresent your identity or affiliation with the Studio
10. Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that development timelines will be met.
11. Limitation of liability
To the fullest extent permitted by law, Emergent Works and its contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid us for the game or service giving rise to the claim in the twelve months before the claim, or (b) fifty U.S. dollars (US $50). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnity
You will defend and indemnify Emergent Works from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Services or your violation of these Terms, except to the extent caused by our own misconduct.
13. Termination
You may stop using the Services at any time. We may stop providing the Services or your access to them at any time. Sections that by their nature should survive (including licenses you granted to us, disclaimers, and limitations of liability) will survive termination.
14. Changes
We may update these Terms. The “Last updated” date will change when we do. Continued use of the Services after an update means you accept the revised Terms. If a change is material, we will try to provide reasonable notice on this website.
15. Governing law
These Terms are governed by the laws applicable where Emergent Works is established, without regard to conflict-of-law rules. If a provision is found unenforceable, the remaining provisions stay in effect. These Terms are the entire agreement between you and us regarding the Services, unless we enter a separate written agreement with you.
